#4 What are the benefits of mediation?

TEXT OF VIDEO:  Hi, my name is Dave Hunter, and I am divorce and family law attorney and mediator here in Utah, and have worked on hundreds of divorce, custody and other domestic cases. This video answers the question: What are the potential benefits mediation? Meaning the benefits of mediating your dispute rather than take it to court. First, mediation provides an opportunity for cooperation: When parties craft a joint solution to your case and issues it usually means the agreement has a better chance of working long-term than solutions imposed upon you by a court. Second, privacy: Mediation is confidential and private as opposed to court which is a public forum. Third, expedited resolution: The vast majority of cases, end with a settlement agreement not with a trial. Trials are actually very rare. There is a very high likelihood that your case will be the same. Mediation expedites the processes by working on settlement from the beginning. Fourth, overall cost savings: Overall, because most cases settle, the real question is when they are going to settle. Will your case settle early on in the process where you might spend $1,000-$3,000? Or will you wait and settle your case on the morning of trial after spending $15 to $20,000 or more preparing for a trial the never happens. Attempting early and often to settle your case can save you thousands or tens of thousands of dollars in legal fees. Finally, making an agreement and settling your case can release you and your family especially the children from conflict that often results from expensive and protracted litigation in court. In nearly all cases, the potential benefits to mediation far outweighs the potential downsides, and choosing to mediate early will usually pay large dividends to you and your family in the long run.
